Please read these terms and conditions carefully before using Romy's Garage.
The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
For the purposes of these Terms and Conditions:
These Terms and Conditions govern the use of this Service and constitute the agreement between You and the Company. These Terms set out the rights and obligations of all users regarding use of the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, You agree to be bound by these Terms. If You disagree with any part of these Terms, You may not access the Service.
Romy's Garage does not run its own age-verification check. Instead, eligibility to use the Service is governed by Apple: You represent that You meet whatever minimum age Apple requires to hold the Apple Account used to sign in and to use the App Store in Your country of residence (including, where applicable, use under a parent- or guardian-organized Apple Account via Family Sharing, subject to Apple's own terms and parental controls).
Your access to and use of the Service is also subject to Our Privacy Policy, which describes how We process information in connection with the Service. Please read Our Privacy Policy carefully before using the Service.
The Service is free to use with limited functionality (the "Free" tier — currently one vehicle project with limited photos, parts, and tasks). Additional functionality — including unlimited projects, photos, and before/after comparisons, PDF build reports, and a detailed budget breakdown — is available through an auto-renewing Pro Subscription, offered on a monthly or annual basis as displayed in the Application at the time of purchase.
The Company may introduce additional Subscription durations or one-time unlock options, or change which features require a Pro Subscription, at any time. Such changes will not retroactively reduce access already granted to existing paying subscribers for their then-current, already-paid billing period.
All payments, billing, and Subscription renewals are handled exclusively by the Application Store (Apple Inc.), charged to the payment method associated with Your Apple ID. Unless cancelled at least 24 hours before the end of the current billing period, a Subscription automatically renews for an equivalent period at the then-current price. You can view, manage, and cancel Your Subscription at any time on Your Device, under Settings → [Your Name] → Subscriptions.
The Company does not process, collect, or store Your payment card details; this information is handled entirely by Apple under Apple's own terms and privacy policy.
Because all transactions are processed by Apple, the Company cannot directly grant refunds. Except where required by applicable law, paid fees are non-refundable by the Company. Any refund request must be submitted directly to Apple Support in accordance with Apple's Media Services Terms and Conditions.
The Company may change Subscription prices from time to time. Any price change affecting an active Subscription will be communicated to You in advance in accordance with the Application Store's requirements and will require Your affirmative acceptance before it takes effect for Your Subscription.
Romy's Garage uses Sign in with Apple solely as a lightweight, on-device gate to control access to the Application — there is no Company-operated server, account database, or user directory behind it. The stable, app-specific identifier issued by Sign in with Apple (not Your real Apple ID or email address) is stored securely in Your Device's Keychain and is also shared with Our subscription-management provider, RevenueCat (see Our Privacy Policy), so that Your Pro Subscription can be recognized if You reinstall the Application or sign in with the same Apple ID on another Device.
You are responsible for safeguarding the Apple ID credentials You use to access the Service. If You revoke Romy's Garage's access under Sign in with Apple (in Your Apple ID account settings), You will be automatically signed out of the Application.
Romy's Garage is a local-first application. Unless You explicitly choose to export it (see below), all Project Data You create — including any photos — is stored exclusively on Your Device and is never transmitted to, or accessible by, the Company or any third party.
You retain full ownership of Your Project Data at all times. Because it never leaves Your Device, the Company cannot access, back up, restore, sell, or otherwise process Your Project Data on Your behalf.
The Application includes an optional "Export data" feature that creates a backup file (containing Your Project Data and photos) which You can share using Your Device's standard share sheet (for example, to save it in Files, a cloud-storage app of Your choice, or transfer it to another of Your devices) — and a matching "Import data" feature to restore such a file. Whether, where, and how You store an exported backup file is entirely Your decision and Your responsibility; the Company has no access to, and assumes no responsibility for, any backup file You create.
The Service does not synchronize Your Project Data across devices or to any cloud service operated by the Company. If Your Device is lost, damaged, reset, or the Application is deleted without first exporting a backup, Your Project Data may be permanently and irrecoverably lost. The Company strongly recommends creating a backup export before switching devices or reinstalling the Application and is not responsible for any resulting loss of Project Data.
The budget, cost, and "remaining budget" figures shown in the Application are calculated solely from the amounts You manually enter and are provided for Your personal organizational purposes only. They do not constitute financial, tax, insurance, or professional appraisal advice, and the Company makes no representation as to the accuracy of any part prices, vehicle valuations, or projected costs You or third parties enter. You are solely responsible for Your own purchasing, budgeting, and financial decisions related to Your vehicle projects.
Because the Service does not maintain a server-side account or store Your Project Data, there is no Company-side account for Us to suspend or delete in the traditional sense. If You breach these Terms, We may, to the extent technically possible, restrict Your access to Subscription features (for example, by revoking an entitlement obtained fraudulently through RevenueCat/Apple).
You may stop using the Service, sign out, or delete the Application at any time. Deleting the Application from Your Device permanently erases all locally stored Project Data (unless You have exported a backup beforehand). Signing out without deleting the Application does not delete Your Project Data from the Device.
Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms, and Your exclusive remedy for all of the foregoing, shall be limited to the amount actually paid by You through the Service during the twelve (12) months preceding the event giving rise to the claim, or 100 USD if You have not purchased anything through the Service.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of Project Data or photos, or business interruption) arising out of or in any way related to the use of or inability to use the Service, even if the Company has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to You. Nothing in these Terms limits any right You may have under mandatory consumer-protection law that cannot be excluded by agreement.
The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects, without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
The laws of the Country (Germany), excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws. Consumer protection laws of Your country of residence may apply and are not restricted by this clause.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of that provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days' notice before the new Terms take effect. By continuing to access or use the Service after those revisions become effective, You agree to be bound by the revised Terms.
